It depends on the film, and it's not necessarily anything to do with royalties. Rule of thumb is that all shots of an actor used for official purposes need to be signed off by their agent.
That's red tape most studios can't be arsed with doing/can't get approved, which is why steelbooks are often "artsy", abstract, minimalist or already approved promo art.
