Do we reply back with the details Tony requested only or forward the letter from BF to the email aswel??

I sent just my Kimchi account and order details as requested, plus I sent a copy of my letter I intend to send once my official letter arrives and changed the ref to my my name and address.

Here's a copy of the letter I received (personal information removed for obvious reasons), sorry for the weird shadows at the bottom, couldn't take a picture without causing one.

A few things I thought I'd point out:

- On the cover page, they specify that the infringing goods are "Recorded DVD" and that the right holder is FACT.

To state the obvious, this is just plain wrong. The items contained are blu-rays, not DVDs. Also, it's not Marvel that has reported this - but FACT, as in the British organisation designed to protect against copyright theft. They won't have a clue if goods manufactured abroad are genuine or not, especially if they don't know where they were ordered from.

- On the last page, they say "if known please state the web address used for ordering the goods"

Again, goes to show that they haven't completed a proper investigation as claimed, else they'd know exactly where it was ordered from (especially considering it states the website on every parcel KimchiDVD send).

TL;DR, it's pretty clear a proper investigation wasn't performed and they don't even know what the goods actually are.

And the icing on the cake, is they send this out so that it arrives the day before Christmas, knowing fully well that the post isn't operating normally and that there are likely to be delays, yet demand a response within 9 days else they'll be destroyed?

Got a reply from Tony too, so I've replied to that and sent an email to the one from the facebook post too, as I wasn't sure if that's him or someone else.
With any luck Border Force should receive my letter telling them not to destroy it on Tuesday.

As in tipped off customs?

Did you get the letter from UK Border Force for Iron Man?

My Drive is stuck since 13th Dec. Wondering if it will suffer the same fate as Iron Man.

Haven't had the letter yet. So god knows. I'm worried that I'll get the letter within the next day or two and it will have the same deadline on it which will be impossible.
I got my Drive's from Nova in good time. My EMS packages seem to get through and not K-Packets. Not sure if this is coincidence or there are different handlers or what.

I've only ever used K-Packet, and for the 8 or so orders before this one they were all received within a week without any issues.
Someone at Border Force has made an incorrect assessment which caused all this trouble, shipping method makes no difference, it could happen any time.
 
Tony's had a lot of grief on this thread for customer service. I'd go with Kimchi over Zavvi any day for customer service. At least you get an honest response (eventually) from Tony. It's coming from a human being who is actually trying to help you out. Not like Zavvi's flippant generic emails that are clearly just trying to dismiss a customer while exerting the least effort possible.
SWIM knows dealers who provide more genuine and honest customer service.
