Yes, that occurred to me but right now it seems that it's the lesser of two evils, and besides - assuming Tony does pony up some official docs, they may well do so as well.

From my understanding after reading BF letter was we have two options

1) to destroy the items
2) give BF permission to investigate

My option would be to go for Opt 2 with the covering letter provided by our ninja member. Any other additional paperwork is irrelvant at this early stage. This will halt the destruction of the steelbooks which will give Tony time to contact them with the licensing details to confirm the items are genuine.

Well, USA has always been one of the most active countries concerning international agreements on intellectual property protection and anti-counterfeiting measures.

TRIPS (Agreement on Trade-Related Aspects of Intellectual Property Rights): "From the late 1970's there was a growing realisation, particularly in the USA, that the counterfeiting of trade marked products was having a considerable adverse impact upon trade revenues".

ACTA (Anti-Counterfeiting Trade Agreement, not ratified): "ACTA was first developed by Japan and the United States in 2006", and "Organizations such as the Motion Picture Association of America and International Trademark Association are understood to have had a significant influence over the ACTA agenda"

Same here, I was actually looking forward to a letter arriving today but no luck, now hoping Parcel Force or the Royal Mail van call later today with my steels (there I go clutching at those straws again) I have my letter almost ready to send just need a reference number and the correct date of receipt of said letter !

Hey come on as much as we have our differences and banta on this forum when theres a situation like this we should be more understanding and help and support each other through the difficult times.
I can't speak for anyone but myself, but I disagree this is a matter caused by Tony and KimchiDVD, and that he is responsible for Border Force's and FACT's actions. This is the result of a false claim that "the goods have been examined by the rights holder and have been confirmed to be infringing an intellectual property right."

I understand what has happened, I wish I could help, and I can only lend moral support. I'd be raising hell if my government acted in this manner.

The United States does not seize licensed, legitimate property of others.

MAY BE subject to legal proceedings... Highly unlikely over some Blu Rays Until Tony proves legitimacy.
 
Bingo! Does anyone think Border Force and UK Customs aren't aware of the "beat customs" tutorials on this forum and others?
I'm sure they're fully aware. Thats why people that have the customs amount declared incorrectly are billed for the correct amount. Goods certainly are not seized due to that.

And now Border Force claims someone has stepped forward and identified the seized goods as "having been examined by the rights holder and have been confirmed to be infringing an intellectual property right." Well, let's see who the "rights holder" is... FACT? :naughty:
If by that you mean some customs officer that doesn't know the difference between a blu-ray and a DVD tried to identify a blu-ray as a 'genuine DVD', then yes 'the rights holder has seen it.
The 'right holder' won't see it at all until you refuse destruction. It's scare tactics, simple as that.

this will work out one way as i see it.
1. they send out customs letters saying fake.
2. you will have to send proof a screenshot of your reciept of what you actually paid for them to check without any proof it will be destroyed.
3. they will then have to confirm that is case with supplier/fact whoever you want and kimchi will have to admit fraud or a mistake on there part on the paperwork. (when they answer back)
4. you get hit with a customs bill to get it.
5.Every release from Kimchi for evermore will get looked over 3-4 times for value and customs charges, some little jobsworth gets a promotion for stopping this and getting the tax it's not rocket science.

the only problem you will get out of this kimchi release's will become more expensive every time as a result of this one release being flagged up, because you will get one person saying i'm losing my money. there will always be one person thats human nature.

Hi Guys.
Sorry for those who are in the position of fighting the UKBF, I have been lucky and managed to get my copies around the 15th Dec. Having looked at a copy of the letter on here, I would just give them the information that they have asked for and no more. That way all they have to do is pass these details,( I'm assuming they go by a database that will have Kimchidvd's name and details on this release), onto FACT, they can then confirm with Paramount. If we all start to send screenshots and too much extra info, this may be counter productive on the declared value front and open up a whole can of worms for the future.
