HMV now in administration said:
People should just be aware of 2 things:
1) If you receive a damaged or faulty copy from now on, you will not receive a replacement or refund
2) If they charge your card and are then unable to fulfil your order, you will not be refunded.

The way a company operates whilst under administration is quite different to how it operates normally, and certain consumer rights are suspended. If anything goes wrong you would have to apply to the administrator or claim against your credit card issuer.

I'd encourage everyone who has orders in with HMV to consider the above, as I'd hate to see anyone here lose their money in all of this.

I've cancelled my pre-order for this (and Looper) as HMV will not be replacing or refunding any damaged steels.

This really needs to go in the opening post.

I would advise everyone to do the same otherwise you could be throwing away your hard earned money.

Best thing I can advise is to pick it up from store. I will pick up as many as I can and will help out others, especially overseas members.

Actually regarding any faulty products, they have a Statutory obligation to replace/refund, however this does apply to faulty goods.

I'm just hoping we actually get any of these HMV Exclusives. :ohno:

There is some news floating around that HMV is being 'scaled back', but that some stores may still exist. All highly speculative at this time, however as only the insiders at HMV know the facts, unfortunately.

Doubtful if they do tbh, afterall taking on a new boss who has managed to see his current and previous companies go into administration within a matter of weeks of each other. :angry:

Because releasing this title will be a source of revenue for the HMV Group, I would assume that administrator Deloitte will still allow it to be distributed and sold. Unless there are huge costs still to be incurred in bringing it to market, it makes more sense to release it, as they will likely sell every copy. It really depends on the current situation between HMV and the manufacturer though, i.e. whether the order has actually been produced yet and how much the manufacturer is owed.

I think that is a very fair Statement , as the Manufacturer may have these allready Boxed ready to go , except the disc's , so they will want to try to recouperate every penny they can from the HMV Order, so not passing it on to HMV , will only agrivate the situation further ?? and they will be Outta pocket allso in the prioccess as it was & still is a HMV exclusive atm.. unless amazon.UK take over the whole operations ?? I caunt see that happening , not that quickly with the UK ecconomy that way it is !!

just spoken to HMV customer service. and all my pre-orders are still active he said and told me has far has he'd been told his that all pre-orders where to be honoured, I then told him that the Looper steelbook was now on amazon and he sounded quite shocked then put me on hold then came back and said this will need checking to make sure whats going on and to call back early next week.

I will say what ever he was told when i was put on hold couldn't of been good has you could tell a change in tone of his voice like he needed to cry.
 
It's an opportunity for the publishers/studios who signed up for HMV exclusives to print thousands more copies as the contract is now void.

Surely they will just be offering existing stock to other retailers? HMV exclusives already have pretty high print runs so it would be foolish to print more.
 
Yeah the main reason why HMV get all the big exclusives is due to their willingness for mahoooosive print runs over other retailers.

I was in hmv this morning and spoke to the store manger and he seemed pretty sure that all online orders should go out as planned and there was definitely not going to be any charges from accounts without goods being sent. I have res ev, skyfall, taken 2 and looper on preorder here's hoping they all get honoured.

Anytime ive asked someone who works in the store they always tell me the online store is run by someone else and they cannot tell me any info about the website part of things. I wouldnt take his word for it if i was you.
