Word of caution from an UK HDN Member about HMV (thanks VRob98)

HMV now in administration said:
People should just be aware of 2 things:

1) If you receive a damaged or faulty copy from now on, you will not receive a replacement or refund

2) If they charge your card and are then unable to fulfil your order, you will not be refunded.

The way a company operates whilst under administration is quite different to how it operates normally, and certain consumer rights are suspended. If anything goes wrong you would have to apply to the administrator or claim against your credit card issuer.

I'd encourage everyone who has orders in with HMV to consider the above, as I'd hate to see anyone here lose their money in all of this.

Well no way I can cancel my order now? Don't know whether or not to hooks out and hope for the best that orders are fulfilled or contact my bank and block HMV?
 
Why cancel? HMV takes the money when the goods are ready to ship.

yep but they aren't offering refunds or replacements so i'm just glad i cancelled my orders when i did now that hmv online is closed, for anyone who have orders just now and if they do get them then there could be some disappointed people as they will most likely have to keep what they get, hopefully hmv online opens up again in time for anyone wanting to cancel.

Except it's not HMV anymore. It's the administrators Deloitte who are running the show now, and who are chasing any revenues they can squeeze out of what's left. Policies on vouchers, gift cards, refunds and exchanges have already been overturned, so the usual process of charging and shipping pre-orders could feasibly be changed too.

Don't forget that whenever you place an order with an online retailer, they pre-authorise the transaction with your card issuer, and the amount stays as a pending debit on your account (though it doesn't show on your statement). So anybody who has orders with HMV and hasn't cancelled them has already authorised their credit card company to issue the funds on request. With a company going into administration that's far from a secure position to be in.

This from Martin Lewis, creator of MoneySavingExpert.com:

"If you are considering making an HMV purchase at the moment, I'd caution against buying online, as it could take your money and then legitimately later choose not to fulfil it and give you no refund."

Granted that's worst case scenario, but it is a possibility.

I just wish I'd made my mind up sooner... I finally decided to cancel my pre-orders but they'd already closed the bloody site down. I was surprised they actually refunded me on Friday for a steelbook I returned, but I'll be even more surprised if all these pre-orders are met. If they take our money rather than just cancelling existing orders, then I won't be a happy chappy!
 
If you don't get product but are charged for an item. won't the credit card company's go after them if you claim you did not get an item?
 
The site is now offline. How can they charge customers on pre-orders? I am going to check with in-store staffs tomorrow to understand what they would do to pre-orders. If they charge it would be criminal.

wasn't it said in a statement that all pre orders would go out as planned????i think its likely that people will get their stuff sent out but just won't get any refunds or replacements for damaged items.

I'm sure they would charge only in expectation of receiving the stock. However, because the situation is so fluid things can change very quickly, and expected stock might not materialise.

I'm not sure in-store staff will know anything about online orders, but here are a couple of numbers to try. They still seem to be active so maybe worth a go during office hours:

Is this going to be on amazon also? Have this and Looper preordered w/ HMV.com and cant cancel now due to no website. I hope we dont get screwed over by this.

Customers who have pre-ordered games or other items with HMV have been told not to worry.

HMV’s PR boss Gennaro Castaldo told Eurogamer that the chain “would intend to follow through on [pre-orders]”.

This, of course, depends on both the business remaining open and suppliers being willing to provide the stock. Neither of which are certain for the time being.

All of HMV’s 239 stores and 4,350 staff remain open and in work for the time being as administrator Deloitte attempts to find a buyer.

"We're doing our very best to continue operating as per normal,” Castaldo added. “There are a couple of areas such as gift cards where unfortunately we can't do that, but effectively we've got new owners now and when you get into an administration it can impact on vouchers and gift cards. But everything else we're doing our best to continue as normal.

"We don't see this as a final chapter; we still believe there is a future. It might have to be a slightly different future, but one we can still try to achieve, so we're working hard to make that happen."

It could well be that HMV, much like GAME before it, successfully finds a buyer and continues on, perhaps in a smaller capacity. Or the brand could live in in a number of guises, such as online or in events.

It’s also possible, though, that its days are numbered.

The chain this morning confirmed that it is no longer accepting gift vouchers or store credit. Should the chain go under gift card holders will of course be able to apply to the administrators for a refund, but those affected should be aware that customers normally fall right to the bottom of the lists when it comes to rebates.

I'm sure they 'intended' not to go into administration either, but the fact is that these things are not in their hands anymore. I believe that interview was given prior to the HMV.com site being shut down by Deloitte.

I agree that there's no need to panic, but even less need to panic if people take a few steps to protect themselves.
