Yes there is an encoding error but the PQ is still superior on the Criterion release as the FOX disc has a bit of filtering applied similar to Braveheart.

Going by Legend & TDTESS, I think with this spate of steels they are going for a minimalist arty mondo styley approach.
Which could suit this film quite nicely.
