Turned out to be another dead end. That was the team responsible for organise IPR but they have nothing to do with goods seized for infringing upon it. And they couldn't even point me where else to turn either. The only positive she gave was that she did say we should have received a letter at the same time as the others if ours had been seized but obviously that doesn't help account for where they are now. Honestly have never come across a situation where it is so difficult to find out information to such a simple question like where is my parcel! No letter for me today either. I think I will wait a few days after new year then ask Tony for a refund.

As in the local royal mail centre or the place where the steels go when you need to pay extra customs? I haven't had a letter to say mine's been seized or is waiting for me to pay extra tax; while I've been making calls though I have had my tracking number run through a few different systems and they've not found it anywhere. Pretty sure mine has been seized and my letter is lost or late.

The sad thing about this entire situation is that the integrity of Kimchi / Tony is being brought into question as a result of one nations customs regulations. The entire situation is exasperated by seemingly long holiday delays that occur this time of the year. Having shipped internationally, I'm quite aware that customs holds sometimes do take a while to clear having had some on hold for up to 6 weeks before being cleared. Basically, some patience is required before moving forward with other options. I think there is a lot of good advice that is not being heeded due to impatience and inexperience. Anyway, here's to hoping for a quick resolution to this problem in the new year.

I have done that, checked at my local delivery office and asked my postman (we get on really well, after all he spends loads of his time delivering to me :p ) and neither could help and they don't have anything there for me either, nor have they returned anything due to non delivery or collection.

As of now, I am thinking of writing off and try to make up for the loss by selling some other collectible stuffs.

I will give it a couple of weeks and if I don't get it I'll make a claim through PayPal and then I guess it will be up to kimchi to make a claim against BF or whoever, I am defiantly not taking the loss on the chin.

I guess that would depend if you felt Tony had done his utmost to resolve the situation.

If you got the Letter from Border Force its very important you sent the letter back telling them not to destroy your goods

If they destroy the goods and its proven they were in the wrong to do so you are entitled to a refund of the value of the goods but beware if you had this marked as merchandize $20.00 that's what you can expect your refund will be

If you tell the real value you paid you most likely will be caught out for avoiding VAT Duty and that's an offence but you still might get the real value back minus VAT Duty and a fine if both sides agree to this

Kimchi might of course Refund customers but that's up to them as this is not lost in the post case but goods seized by customs
If it was just lost in post then Kimchi would have to refund you under distance selling rules and sales of goods act

On a separate note
Problem I have noticed recently with Kimchi is they have not been including any invoices inside the packaging but only marking the value on the customs label

They need to make sure there is an invoice inside the packaging

Say Tony refuses to refund as he had done his best, where do we stand here? Aren't we compromising our own integrity by disputing the transaction, and wouldn't that end up with Kimchi denying to ship to the UK or refuse to declare the requested value?

My heart says we shouldn't dispute if one can suck up the loss. [emoji40]

If Border Force has your Parcel and you got the Letter
You cant claim with PayPal not delivered lost in post as that is not what has happened
Its goods seized by customs and you would need to make your claim for a refund with Border Force/Customs

Kimchi have responded by sending all the needed proof goods are legal
They don't have to refund customers but they might still do this but they are not obliged to do so as its goods seized by Border Force/Customs

IF all customers sent the letter back instructing not to destroy their goods and its proven goods are legal to be sold then in time your goods will be delivered
How long this will take is unknown

To all who got this Letter just make sure you sent back your reply to not destroy the goods and don't wait for this to be sorted by Kimchi as it might take a while before Border Force agree this release is not counterfeit goods

Its possible Kimchi might not allow with future orders to mark goods as $20.00 for the UK as its now very likely that it will get noticed if customers put refund claims in with border force for real value paid if their goods got destroyed

That's only if goods are proven to be counterfeit goods then the seller would be required to refund you or you could get your refund from PayPal or Bank if paid by credit card
As these are not counterfeit goods that's an issue Kimchi can avoid if they wanted to

I expect though Kimchi will sort customers out either way but its very important the letter is replied to with instructions not to destroy the goods

If its proven the goods are not counterfeit then the fault lies with Border Force/Customs not Kimchi

If this was Zavvi, the matter wouldn't even be up for debate.

If you end up receiving the steel, then reissue the payment to Kimchi.

If it was me, I would ask for a refund from Kimchi and give them a few days grace to sort it out.

Then go to PayPal. You haven't received the item and the tracking will show this. You should be covered mate. :thumbs:

Gutted for you, honestly :(

I respect your opinion, but requesting a refund for an item you have not received is just the common sense thing to do.

If it somehow arrives after the refund and the person keeps it and does not pay, that is more of an issue of morality. I will never pay for fresh air.
