This time, Marvel is being sued for the way it has packaged The Avengers box set. A German manufacturer of luxury travel briefcases has taken Marvel and owner Disney's Buena Vista Home Entertainment into federal court in California over its attaché case products, which are prized by the company "for being impervious to the elements and being virtually indestructible."

Well, maybe not totally indestructible. Rimowa GmbH, the plaintiff, claims Marvel has damaged the trademarks on its carrying case.

The lawsuit follows the dispute between Louis Vuitton and Warner Bros. over a knockoff handbag that was used in The Hangover Part II. In that case, the French fashion house said that within the film, a Chinese fake was used briefly in one scene and that it had hurt its brand. A judge dismissed the lawsuit on First Amendment grounds; it's currently on appeal.

Rimowa says its Topas attaché case was used by Samuel L. Jackson's character Nick Fury in The Avengers as a repository of dossiers on the various superheroes. Unlike what happened in Hangover II, Marvel was provided with the genuine product, and the German company says it has no issue with the way it was used in the movie.

"However, Marvel did not obtain any license or authorization from Rimowa to make replica copies of the cases for any purpose," says the plaintiff in the new lawsuit.

Specifically, the defendants are accused of marketing and advertising a product called Marvel Cinematic Universe: Phase One -- Avengers Assembled Box Set for shipment starting Sept. 25. Marvel's marketing materials indicate the product will consist of the Blu-ray versions of The Avengers and several other Marvel superhero pictures and bonus discs.

According to the complaint, "Images of the replica briefcase on Marvel's advertising materials, and fan video from Marvel's product display at this year's Comic-Con convention, show the plastic 'replica case' to be a close copy of Rimowa's Topas attaché case in every respect but quality -- from the proportions and coloring, to the style of the handle and latches, and, of course, in the use of the trademarked parallel ridges around the body of the case."

Rimowa is alleging trademark infringement, trademark dilution and unfair competition and is seeking to enjoin Marvel from further infringement. The plaintiff is demanding a jury trial, all profits from allegedly unlawful conduct and an award of three times plaintiff's actual damages to be proved. The company's lawyer is Anjani Mandavia."

Amazon just took this down, my pre-order is still up but the lawsuit maybe the reason. I hope its just sold out but there is text on the Amazon (US) page for this that says:

Please be advised this item is currently under review and is not available to pre-order.

If they have been produced then they will be damn near forced to a settlement in which they give more profit to them ... then, that means they may raise the price of this edition to make up for it... so those who pre-ordered better hold tight. If they havent produced these then they will scrap the entire thing ... so then anyone who has one will have uber rare collector item. My guess is with the amount of these having to be made that its already been in production and half if not all are already done.

they're gonna make some other briefcase or some collector box instead I bet ...

check out the official site they took down the briefcase pics and edited the descrip and nowhere does it say briefcase it now just says exclusive collectible packaging.

Well this sucks. I was looking forward to this one. BUT it doesn't necessarily mean we won't see it just probably a higher price like Wreak said.
Maybe they can drop the plastic make it metal. Then higher price could be understandable.
 
It could be a tin like the Blade Runner DVD one or the X-Men style blu ray boxset on offer in some countries round the world. They could probably re-design the brief case
 
Ive been thinking... Surely this whole saga only has a couple of possible outcomes?

The set hast been released yet so you could argue no trademark infringement has happened, its not like its already out there on sale, (similar to a sample on a record, an unauthorised sample on a released track ends up in a lawsuit and maybe a ban of the track and payment to the artist being sampled, usually way more than if permission was asked and agreed before a track is released) so if Disney pull it before release, no infringement, no lawsuit, no money for Rimowa......

The lawyers state if its released, then there will be a trademark infringement and so Disney remould the case minus ridges, produce a non 'replica' case and it becomes a generic briefcase, no infringement, no lawsuit, no money for Rimowa.....

The Lawyers could of course argue that the Bluray set is a replica of a movie prop and not the attache case itself (which it is) and the prop is significantly different from the attache case its based on, it couldnt be mistaken for a genuine Rimowa attache case, its not like its a bluray set inside a fake Channel bag which could be used as a bag independently of the Blurays, take all the Avengers stuff out of the case and its still a prop replica case, you couldnt use it as an attache case.

Disney scrap the whole set, no lawsuit, no money for Rimowa....

Disney want to release the case as its already in production so its too late to change it, and so reach some kind of deal with Rimowa, maybe a one off payment, a royalty or whatever, no lawsuit, but money for Rimowa....


I can only see one outcome that involves any kind of financial 'reward' for Rimowa, and that involves the set being released as is....so is it all down to weather Rimowa's motives are financial rather than harm to their brand and they would be happy for the set to be released if they were compensated, or they want it withdrawn altogether, or Disney deciding if the penalty paid to Rimowa by releasing the set as is, would be too much of a dent into their profits, making the release pointless from a business point of view...

Often the flyers are planned and printed way in advance. They may not have been able to stop that train fast enough haha....

Yea the flyers in general are planned out 2 months in advance and then they print them out for review 6 weeks ahead of time....and even though it may say it in print, best buy can post signs all over the store apologizing for the inconvenience due to the manufacturing error.
 
It's still for sale on the official site (see link at the top of this page) but all artwork has been removed. So i guess they're going to go ahead with this release but it may well have to be with different collectible packaging depending on the outcome of the suit between Marvel and Rinowa.
 
They need to hurry up and let us know what the hell is going on, we need to know if its being released/delayed or not and in what kind of package. The whole selling point of this release for me is the case, without it its kinda pointless (as cool as the contents is) I dont care if its redesigned into a generic briefcase as long as its a similar looking design as long as the artwork is released and Im given time to either accept the new looking set or cancel my order, its 3 weeks or so away from release, time to inform customers as to what they are getting for their money!

Well, the official site now has no mention of this Collector's Set, just the regular blu-rays so who knows what's going to happen with this release.

I just read on Collider that this has been delayed with no new release date set. Hopefully thats all it will be a delay and we will still get it. I was looking forward to getting this it looks like a awesome set!
