The story of a man who was choked to death by a CVS employee after stealing toothpaste from the Chicago store on Saturday is getting even more scrutiny, after police admitted Monday that a Cook County sheriff's officer was on the scene when the man, Anthony Kyser, was killed.

Kyser, a 35-year-old barber, was chased out of the Little Village store and restrained by an employee of the store who saw him stealing, the Chicago Sun-Times reports. The employee then strangled him to death.

Witnesses said Kyser, of the 1400 block of South Hamlin, cried, "I can't breathe, I can't breathe!" as the CVS worker held him in a chokehold for what they thought was several minutes.
Witnesses told the newspaper that there was an off-duty officer on the scene while Kyser was being choked, and after initially saying they were unaware of a police presence, the Chicago Police Department now admits that a Cook County sheriff's officer was on the scene:

As the correctional officer pointed a weapon at Kyser and told him to stop struggling, Kyser repeatedly pleaded that he couldn't breathe, the witnesses said.
[Chicago Police Lt. Lt. Maureen] Biggane said a surveillance video shows the correctional officer in the alley, speaking on a cell phone, but does not show her pointing a weapon. The officer waited for an ambulance to arrive, but left before uniformed Chicago Police arrived, Biggane said.

Police wouldn't release the correctional officer's identity. Sheriff's spokesman Steve Patterson said there is nothing for the sheriff to investigate, based on Chicago Police's account of her actions.

Chicago Police will not press charges against the unnamed CVS manager, despite a medical examiner's finding that man's death was a homicide, reports MyFoxChicago.

Kyser was accused of stealing tooth paste and crayons, the Chicago Tribune reports.

Kyser was known as "Pops" to his three former step-children, reports the Chicago Tribune. Kyser's ex-wife Ann Marie Balboa questioned the police department's decision not to press charges against the CVS manager:

"How's it accidental?" Balboa said. "You're choking the [expletive] out of somebody. He [the employee] should be fired. He should be facing criminal charges. You don't take someone's life over toothpaste."

Witnesses told the Sun-Times the officer never told the employee, who has been placed on leave by CVS, to release Kyser. The witnesses also said the officer can be seen pointing a gun at Kyser on the surveillance video. Police also have not explained why the off-duty officer left the scene before uniformed officers arrived.

Actually I'd disagree. He did a STUPID thing. CVS has insurance to cover anything stolen. This guy could have just blown the CVS guy away had he had a gun with him...

Plus, IDK about this state, but in a lot of states it's actually illegal for the worker to chase you.

Here's in CA an employee can't chase you or even touch you for that matter if someone steals something. Everything is a potential lawsuit. You are told that during training.

Anyway, that was just unnecessary. He could of just brushed it off. Just like Jef said CVS has insurance for anything stolen and can make a claim to get the money back. The employee did a stupid thing, now CVS can face a lawsuit if this individual has family and the city can face another lawsuit towards the officer for not doing a thing.

I mean if you try to steal a piece of gum Cali, would you want any bodily harm done to you for it? I am sure your answer will be yes, but think again that person didn't deserve to go out that way.

Like I said, he didn't deserve to die, but catching the guy I believe is the right thing. Even if its just to scare him. He's less likely to do it again. People steal more and more because nothing ever happens to them.

The guy needs to be charged with Murder. He had no right to contain the man, especially with an off-duty officer there. BOTH of them need to be fired, and the CVS guy needs to be charged for manslaughter AT LEAST!

These companies screw over people DAILY. Do you think Target pays their Indonesian employees fair wages to make that store brand tooth paste? How is that not stealing, or even slavery? Who cares if someone screws them over for some toothpaste?

i didn't say the life was worth less. i said killing the person was wrong but stopping him, was right.

No the Indonesian people need to protest, and ask for higher wages... stand up for yourselves. Again, i don't see any of them doing that, or complaining so they must enjoy what they get paid.

lets play hypotheticals... I steal some soap because I'm poor and obviously smelly, heck I don't really have much to go for and honestly if I get arrested I'll get some free room and board and meals to eat. You're going to chase me down and attempt to beat me up over it because I deserve it right?

Stealing is wrong, but do you really think the loss on the 40% markup CVS toothpaste is going to be noticed by the employee collecting their hourly wage?

Let's just look at the items he's stealing. Toothpaste, and crayons. This isn't robbing you out of your pockets is it? He's not taking money from the register is he?

This sounds like a guy who didn't have any money to afford toothpaste or crayons but wanted to keep up his hygeine and get something for his kids to play with, and you're going to kick his ass for it because stealing is wrong?

Corporate America and it's laws can suck my big fat wanker when it comes to me being out of money, and I'll welcome any dumbass who wants to chase me down over bare necessities. Hell if I saw that guy stealing that stuff I would have gladly looked the other way. Think of how desperate you'd have to be to steal toothpaste and crayons? I feel sorry for the bastard already, now some ******* not only beat him up but then choked him to death for a total net of $5-6.

America has plenty of toothpaste and crayons to spare, Cali, believe me there are more important things to worry about people stealing. If anyone deserved anything, the employee deserved a swift kick in the nuts and his head curb stomped for being such a pompous ass.

so if its your stuff you care, but since it is someone else's stuff you don't care... That makes tons of sense. Whatever happened to being to nice to everyone, seems like people only care about themselves now.

When I worked for another really large pharmacy chain, we saw things walk out of the store. 95% of the time we didn't persue, but we did call the police. I really didn't see a point in getting hurt over some gum, soap, tylenol, whatever. The store could absorb the loss and not even blink an eye.

I'm not a fan of shoplifting, but from the big business view, they would rather lose $3.50 to shoplifting than lose $3.50 from shoplifting and several million in a wrongful death suit to a family of an employee that chased the shoplifter and was killed. We did our best to give a description of the person and what they stole to the police. They get paid for that kind of stuff. Our police force was good at what they did, and I thank them for everything they do.

Well If I had a police force that actually worked, I might do that... though the chasing outside of company grounds wouldn't allow for them to be sued as its in their law-books, that it explicitly says do not chase outside.
