I now have confirmation that I can announce ... for all those worried about future packaging from Zavvi. My Play contact has been working with zavvi as well on this mission for better packaging. Between the 3 of us and the future comments from this community after its in place I'm sure it will be go over well.

Have zavvi stopped allowing the 10% student discount on pre-orders? Just tried it then on The Purge steelbook and did not accept it. Are there any other codes out there at the minute?

I can't believe Zavvi are now saying if disc is ok only partial refund how can they get away with that?
So now they can sell you a damaged Steelbook but that's ok as the disc is not damaged it beggars belief.

If Zavvi start playing this game, you could always snap the disc in half and tell them thats damaged too

Has anyone been charged for next weeks releases yet? On monday 18th i'm expecting Black sunday, City of the living dead, Winter soldier and all Indiana Jones steelbooks but as yet i've not been charged for any and obviously none have been dispatched. Normally it would be tuesday or wednesday at the latest.

I was charged for La Haine on Monday, then it was dispatched. I am also aware that Copland was dispatched on Monday, but apart from that I do not know of any other 18th August releases being dispatched as of yet. I too am waiting for all four Indiana Jones' and The Deer Hunter. Hope this has helped.

Thats strange, maybe they got in trouble for charging that 1% extra...or maybe they don't want us to have the option to file a claim with paypal at our backs, wouldn't surprise me with all the bs they're up to.

I'm honestly getting fed-up of the constant stream of cock-ups on Zavvi's part, as well as the shifty practices they subscribe to (such as selling apparently "sold out" SteelBooks on eBay and Play.com for a higher price)

It seems to be one thing after another with Zavvi. If it's not packaging issues, it's last-minute release date changes. Their promotions are a joke; they hardly ever lower prices for pre-orders (insisting on running ridiculous promotions, causing you to cancel your prior orders and order again); the inability to cancel items which were part of a promotion (causing you to cancel the whole order, even if some items are sold out and can't be re-ordered); and trying to find an order amongst dozens using their orders page is a terrible user experience!

Zavvi needs to pull their socks up and fix these underlying issues ASAP! As stated by members above, Zavvi have us over a barrel by having exclusives, and they know it! If they didn't offer exclusive SteelBooks, how many people here would even bother using Zavvi? Hardly any I would guess! By offering exclusives they can keep treating us like dirt and know we'll keep coming back for more!

Who here doesn't feel like a battered husband, trying to fix a marriage for the sake of their kids?

I ordered total recall off them a couple of weeks ago, at a nice price of £11.99, had a couple of emails with the usual 'trying to get hold of it' then an email saying they can't get it and it is now out of stock here's 10% disc blah blah, but it is still on the website but now at £24.99 I get onto them and question this and they say they oversold, but don't answer why it is still being advertised at double the price I ordered it for, so have sent one back saying they don't seem to grasp what I am saying 'why is it still on your site if you don't have it then?' Will see if they reply

It's been a while since I've used account credit on my orders. Does anyone know if the price on the shipping label reflect the new order total after account credit has been applied, or will it show the current item price on Zavvi? When applying Zavvi rewardz points I know it shows label shows the order total after discount, but I just don't remember how it works with credit. Could anyone who's recently ordered a steel using account credit let me know?

To quote my mate who is a lawyer. You're paying for the entire item not just the discs and under the sales of goods act 1974 they either have to give you a replacement or total refund. It's that simple....... Any lawyer would have a field day with Zavvi. They wouldn't last 30 seconds in court.

I expected that the Distance Selling Regulations come into play as well. If you went into a shop you have the chance to inspect the goods and reject them if damaged. Under Distance Selling you can't do that untill they arrive.

The same criteria still applies. You're buying goods that are new and mint not damaged and it's up to Zavvi to get you those goods in A1 condition. They are actually doing themselves no favours with the poor packaging as that's open season for a law suit......

I'm a bit concerned about the paypal payment option disappearing as i have several existing pre-orders through PP. It would be very typical if come release date our orders state 'payment problem' or something of the like and we miss out on a bunch of steels.
DB. Mods - please press them about this issue. God knows they wont tell their customers.
Thank you.

this was the reply.....

Hello David,

Thank you for getting in touch about the item "Total Recall - Limited Edition Steelbook - Triple Play (Blu-Ray, DVD and Digital Copy) [Blu-ray]" this item is avalaible again on our site but at a higher price.

The earlier stock of this item sold out quicker than we predicted, unfortunately we are not able to amend the current price.

If there is anything else that we can do, then please do not hesitate to get in touch

Kind regards, Colin

is this legal?

is this legal?
Having looked at Zavvi's TOS, yes it is indeed legal as they explicitly state that any orders are considered "offers" which are not subject to acceptance until it's dispatched.

A snippet of point 9 of their TOS.

"Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit, debit card or PayPal account or (ii) dispatch the goods to you or commence the services, whichever is the later."

For future reference, the distance selling: how the law protects you & How a distance sale contract is made articles on the Adviceguide website may be of use.

In other words, no matter if they've charged you or not they can change their mind about fulfilling any order at any time (provided they refund you assuming they've already charged you), because until they dispatch the goods they haven't "accepted" your offer of purchase.

Hope this helps!
